OVERVIEW

Welcome to GILDLAMPS. GILDLAMPS is operated by GILDLAMPS INC. The terms "we", "us", and "our" refer to GILDLAMPS INC.

These Terms of Service, together with the policies referenced herein, govern your access to and use of our website, products, services, and related features (collectively, the "Services").

By accessing or using the Services, you agree to these Terms of Service and our Privacy Policy.

SECTION 1 - ACCESS AND ACCOUNT

You must be legally permitted to use the Services and enter into purchases in your jurisdiction.

You are responsible for providing accurate, current, and complete account, billing, payment, and shipping information and for maintaining the security of your account credentials.

SECTION 2 - OUR PRODUCTS

We make reasonable efforts to provide accurate product descriptions, photographs, dimensions, materials, finishes, specifications, availability, and pricing.

Product colors and appearance may vary slightly because of screen settings, photography, lighting conditions, manufacturing variations, and natural variations in applicable materials.

Where a product contains natural or decorative materials, reasonable variations in color, texture, veining, pattern, or appearance may occur.

SECTION 3 - ORDERS

When you place an order, you are making an offer to purchase. GILDLAMPS INC may accept or decline an order where reasonably necessary, including because of product availability, suspected fraud, payment authorization issues, material pricing errors, or shipping restrictions.

Please review your order information, product specifications, quantity, shipping address, and contact information carefully before submitting your order.

If you need to request an order change or cancellation, please contact info@gildlampsinc.com as soon as possible.

SECTION 4 - RETURNS AND REFUNDS

Returns and refunds are governed by our Refund Policy.

Eligible standard products may be returned within 30 calendar days from the confirmed delivery date, subject to the applicable return eligibility requirements.

Before shipping any return, customers must contact info@gildlampsinc.com and obtain return authorization and applicable return instructions.

Please do not ship a product before receiving return authorization and return instructions from GILDLAMPS INC.

For preference-based returns, the customer is responsible for the applicable return shipping cost.

If a product is confirmed to be damaged, defective, incomplete, or incorrect and an approved return is required, GILDLAMPS INC will cover the reasonable approved return shipping cost.

No restocking fee is charged on eligible returns.

SECTION 5 - DAMAGED OR INCOMPLETE PRODUCTS

If a product arrives damaged, defective, incomplete, or different from the product ordered, please contact us as soon as reasonably possible and provide the order number together with photographs or other information reasonably necessary to review the issue.

Where damage to a large or fragile lighting fixture is limited to an individual replaceable component, such as a glass panel, crystal piece, shade, or related part, GILDLAMPS INC may provide an applicable replacement component at no additional charge after the issue has been verified.

A full-fixture return will generally not be required where the issue can reasonably be resolved through replacement of the affected component.

If a replacement component is not an appropriate solution, we will work with the customer to provide another reasonable resolution in accordance with our Refund Policy.

SECTION 6 - CUSTOMIZED PRODUCTS

A product is considered customized only when it is specifically manufactured or modified according to customer-requested non-standard specifications.

Examples may include non-standard dimensions, finishes, configurations, hanging lengths, electrical specifications, personalized features, or other modifications that differ from the standard options offered on the applicable product page.

Once production or customization has begun, custom orders cannot be canceled.

Upon delivery, customized fixtures are not eligible for preference-based returns.

These restrictions do not affect applicable rights or remedies if a customized product arrives damaged, defective, incomplete, incorrect, or materially different from the specifications approved by the customer.

SECTION 7 - CUSTOM ORDERS, PROJECT ESTIMATES, AND PROMOTIONS

Sitewide retail promotions and promotional codes are generally intended for qualifying standard retail orders.

Custom lighting orders and project estimates cannot be combined with sitewide retail promotions, including promotional code GL22, unless otherwise expressly stated in writing by GILDLAMPS INC.

Trade Program pricing, project pricing, custom quotations, negotiated pricing, and other special pricing arrangements may also be excluded from additional retail promotional discounts unless expressly stated otherwise.

SECTION 8 - TRADE PURCHASES

Qualified interior designers, architects, builders, contractors, hospitality professionals, developers, retailers, and other approved commercial customers may participate in our Trade Program where applicable.

Trade Program customers may purchase products for qualifying residential, hospitality, commercial, professional, or resale purposes where permitted by applicable law and applicable Trade Program terms.

Trade customers remain responsible for providing accurate business, tax, resale, or exemption documentation where applicable.

SECTION 9 - PRICES, PROMOTIONS, AND BILLING

Prices, discounts, and promotional offers may change from time to time.

The price applicable to an order will be the price displayed and confirmed during checkout, subject to correction of material errors where permitted by applicable law.

All prices on our website and during checkout are displayed and processed in U.S. dollars (USD).

Unless otherwise stated, displayed product prices do not include applicable sales taxes or optional expedited, specialized, or special delivery services.

SECTION 10 - SHIPPING COSTS

Free standard shipping is available for orders delivered within the 48 contiguous United States. No minimum purchase amount is required.

Alaska, Hawaii, Puerto Rico, other U.S. territories, and locations outside our standard free-shipping area may be subject to additional shipping charges or shipping restrictions based on available carrier service.

Any applicable shipping charge will be disclosed before the applicable shipping service is confirmed.

SECTION 11 - DUTIES AND CUSTOMS - DDP

All orders shipped to the 48 contiguous United States are delivered DDP (Delivered Duty Paid).

Applicable import duties, customs clearance charges, and related import fees for qualifying orders are fully covered by GILDLAMPS INC.

Customers receiving qualifying orders within the 48 contiguous United States will not be required to pay additional import duties or customs clearance fees upon delivery.

SECTION 12 - SHIPPING AND DELIVERY

Orders generally require 2–4 business days for preparation and quality inspection after payment authorization.

After shipment, estimated transit time is generally 6–12 business days.

The estimated total delivery window is generally 8–16 business days from payment authorization.

Delivery timeframes are estimates and are not guaranteed. Severe weather, carrier disruptions, peak periods, oversized freight requirements, remote delivery locations, address issues, transportation disruptions, and other circumstances outside our reasonable control may affect delivery timing.

SECTION 13 - SHIPPING ADDRESS RESPONSIBILITY

Customers are responsible for providing a complete and accurate shipping address and contact information at checkout.

We will make reasonable efforts to correct an address before shipment when contacted promptly, but address changes cannot be guaranteed once fulfillment or shipment preparation has begun.

Reasonable costs resulting from an incorrect or incomplete customer-provided address, refused delivery, or repeated unsuccessful delivery attempts may be the customer's responsibility, except where the issue resulted from an error by GILDLAMPS INC or the applicable carrier.

SECTION 14 - INTELLECTUAL PROPERTY

Website content, trademarks, logos, graphics, photographs, text, videos, product information, and other protected content may be owned by GILDLAMPS INC, its licensors, suppliers, or their respective rights holders and are protected under applicable intellectual property laws.

Protected content may not be reproduced, distributed, modified, republished, or commercially exploited without appropriate authorization except where otherwise permitted by law.

SECTION 15 - THIRD-PARTY TOOLS AND SERVICES

Third-party tools, platforms, payment providers, logistics providers, analytics providers, and other services may be used in connection with our Services.

Such third-party services may be subject to their respective terms, conditions, and privacy practices.

SECTION 16 - RELATIONSHIP WITH SHOPIFY

GILDLAMPS uses Shopify technology to operate its online store.

Purchases made through our store are transactions directly between the customer and GILDLAMPS INC.

SECTION 17 - PRIVACY

Personal information collected through our Services is handled in accordance with our Privacy Policy.

SECTION 18 - REVIEWS AND FEEDBACK

If you voluntarily submit reviews, photographs, feedback, suggestions, or other content, you represent that you have the necessary rights to provide that content and that your submission does not violate applicable law or another person's rights.

SECTION 19 - ERRORS, INACCURACIES, AND OMISSIONS

Information on our website may occasionally contain typographical errors, inaccuracies, or omissions relating to product descriptions, specifications, pricing, promotions, availability, shipping, or other information.

We may correct material inaccuracies and, where legally permitted, cancel or refund an affected order.

SECTION 20 - PROHIBITED USES

You may not use the Services for unlawful, fraudulent, malicious, infringing, deceptive, abusive, or security-compromising purposes.

SECTION 21 - DISCLAIMER OF WARRANTIES

We make reasonable efforts to provide accurate information and reliable Services.

To the fullest extent permitted by applicable law, the Services are provided "as is" and "as available."

Nothing in these Terms excludes rights or remedies that cannot lawfully be excluded.

SECTION 22 - LIMITATION OF LIABILITY

To the fullest extent permitted by applicable law, GILDLAMPS INC will not be liable for indirect, incidental, special, punitive, or consequential damages where such limitation is legally permitted.

SECTION 23 - INDEMNIFICATION

To the extent permitted by applicable law, you agree to indemnify GILDLAMPS INC against third-party claims directly arising from your unlawful use of the Services, violation of these Terms, or violation of another person's rights.

SECTION 24 - SEVERABILITY

If a provision of these Terms is determined to be unenforceable, the remaining provisions will continue in effect to the fullest extent permitted by law.

SECTION 25 - GOVERNING LAW

These Terms of Service shall be governed by and construed in accordance with the laws of the State of Florida, United States, together with applicable federal law, except where applicable consumer-protection law requires otherwise.

SECTION 26 - CHANGES TO TERMS

We may update these Terms from time to time to reflect changes to our Services, business practices, store policies, or legal obligations.

The current version will be posted on this page together with the applicable effective or updated date.
